Article 8 - Delivery
Emanuela Borello company ships throughout Italy, excluding Vatican City and the Republic of San Marino. In Europe, it ships to Austria, Germany, France, Belgium, Holland, Sweden, Spain and Portugal.
Emanuela Borello company will only deliver to the user's address provided at the time of purchase.
Delivery takes place, for the Italian territory, generally within 10 working days, or, if no delivery date is specified, within the estimated time specified at the time of selection of the delivery method and, in any case, within the maximum term of thirty days from the date of confirmation.
For EU countries, delivery will be made within 15 working days and in any case, within the maximum term of thirty days.
If it is not possible to make the delivery, the order will be sent to the warehouse. In this case, a notice will specify theplace where the order is located and the methods for agreeing on a new delivery.
If you are unable to be at the delivery location at the agreed time, please contact us again to arrange a new delivery date.
If delivery cannot take place for reasons beyond our control after thirty days from the date the order is available for delivery, we will assume that the contract is to be terminated.
As a consequence of the termination, the amounts will be refunded, including delivery costs, with the exclusion of any additional costs arising from the choice of a delivery method different from the ordinary method offered withoutunjustified delay and, in any case, within 15 days from the date of termination of the contract. Transport arising from the termination of the contract may have additional costs that will be borne by the buyer.
Shipping costs are borne by the buyer and are clearly indicated at the time of ordering.
Article 9 - Risk Transfer
The risks relating to the products shall pass to the purchaser from the moment of delivery. Ownership of the products shall be deemed to have been acquired upon receipt of full payment of all amounts due in relation to the same, including shipping costs, or upon delivery, if this occurs at a later date.
Article 10 - Warranty and Commercial Conformity
The seller is responsible for any defects in the products offered on the website, including the non-conformity of the items to the products ordered, in accordance with Italian law.
If the purchaser has entered into the contract in the capacity of consumer, i.e. any natural person acting on the website for purposes unrelated to any entrepreneurial or professional activity that may be carried out, this warranty - as it concerns food products - is valid on condition that the defect occurs immediately from the date of delivery of the products; that the purchaser submits a formal complaint regarding the defects within a maximum of 2 days from the date of delivery; that the online return form is correctly filled in.
In case of non-conformity, the purchaser who has entered into the contract as a consumer shall have the right to obtain the restoration of conformity of the products free of charge, by means of replacement, or to obtain an appropriate price reduction or the termination of the contract in relation to the disputed goods and the consequent return of the price.
All costs for the return of defective products shall be borne by the seller.
Article 11 - Right of Withdrawal
In accordance with the legal provisions in force, the purchaser has the right to withdraw from the purchase without any penalty and without specifying the reason, within 14 days if he has not yet received the product pursuant to art. 57 of Legislative Decree 206/2005.
The purchaser who intends to exercise the right of withdrawal must communicate this to the company Emanuela Borello by means of an explicit declaration, including name, surname, geographical address and, if available, telephone and fax number and e-mail address, which may be sent by registered mail with return receipt or by e-mail, before the expiry of the withdrawal period.
The right of withdrawal referred to in articles 52 to 58 for distance contracts and contracts negotiated outside commercial premises is excluded in relation to:
a) the supply of goods that risk deteriorating or expiring rapidly; b) the supply of sealed goods which are not suitable for return for reasons of hygiene or connected to the protection of health and which have been opened after delivery.

The goods must be returned intact and complete in all their parts. Without prejudice to the right to verify compliance with the above, the website will refund the amount of the products subject to withdrawal within a maximum of 14 days, including any shipping costs.
As provided for by art. 56 paragraph 3 of Legislative Decree 206/2005, amended by Legislative Decree 21/2014, the website may suspend the refund until the goods are received or until the purchaser demonstrates that he has returned the goods.
The website will make the refund using the same payment method chosen by the purchaser at the time of purchase. In the case of payment by bank transfer, if the purchaser intends to exercise his right of withdrawal, he must provide the bank details: IBAN, SWIFT and BIC necessary for the refund.
